What Jurors Find Important in Their Verdicts    
12:00 – 1pm on March 1st, 2009

Tammy Metzger gave a 1-hour talk on how jurors arrive at their verdicts and how they (mis)understand the verdict form.  She played video clips from a December 2009 Harris Martin mock trial conference of a benzene lymphoma trial, which she organized and gave a talk.  She also played video clips of mock trial deliberations and focus group research on toxic tort cases to demonstrate how attorneys can more effectively communicate with jurors. The State Bar of California has approved this lecture for 1 hour of MCLE credit.

Trial of a Benzene-Leukemia Case from Jury Selection to Verdict

     Tammy conceived the format and helped implement this conference, which was the first benzene litigation conference done as a trial.  Vicki Gilbreath said that this was the most well-attended, best-received benzene conference at Harris Martin ever.  Tammy recruited a demographically matched jury panel, prepared an insightful questionnaire, summarized the mock jurors’ answers, accurately predicted their reactions to the testimony, arranged for real-time feedback throughout the trial and selected a sitting judge to preside over this interesting event.

Tammy also spoke about the following:
        • Jury Selection from the Plaintiff’s Perspective;
        • Jurors’ reactions to the mock trial; and
        • Provided constructive criticism on the attorneys’ and experts’ presentations.

 

Mealey’s Benzene Litigation Conference

December 4-5, 2006
The Ritz-Carlton Battery Park in New York City

     Tammy participated in a 2-hour demonstration entitled Choosing a Jury, along with Thomas Girardi, who voir dired a random panel of volunteers.  She also presented a paper, entitled Plaintiff’s View of a Benzene Leukemia Case, which Tom Girardi endorsed, saying your paper is the best, most concise explanation of how to conduct jury selection. I gave it to all of my associates to read.” 

Tammy spoke about the following:
        • Jury selection goals and techniques;
        • Bias, attitudes and life experiences
        • Personality types and demographics
        • Commented on the jurors’ responses and body language;
        • Explained whom she would strike and why.

 

Attorney Training, Workshops and Individual Feedback

Tammy provides attorney training classes, which permit discussion and individual feedback regarding many topics, including voir dire, reading and responding to body language, overcoming jury (and judicial) bias, effective communication skills, storytelling techniques and how people process scientific evidence.  She will also customize a training session to meet your needs. 

The voir dire and communication skills workshops include a mock jury, which provides moment-to-moment feedback via response dials.  High quality cameras record these sessions, with a graph of the jurors’ reactions superimposed over the video.  You can review the DVDs to see what resonates with jurors and what needs work.  This is a powerful tool to help you refine your speaking style.
